Terms & Conditions

1. Consultation and eligibility

The consultation form is available only to people aged 18 or older. Submitting a brief does not create a paid commission and no payment is taken at this stage. Private World Studio may decline any enquiry in its discretion where the request falls outside the studio’s creative, legal, safety or capacity requirements.

2. When a commission begins

A paid commission begins only after Private World Studio issues a written proposal or service agreement and the client accepts it in the manner stated there. The proposal identifies the project scope, deliverables, schedule, fees, payment stages, included revisions and any project-specific conditions.

3. Client information and warranties

The client must provide accurate information and must have the necessary rights, permissions and authority for all references and materials supplied. The client warrants that a character described as fictional is not intentionally based on an identifiable real person and that the commission is not being used to evade the Content & Likeness Policy.

4. Age, likeness and sensitive content

The Content & Likeness Policy forms part of these Terms. Nude, erotic or sexually suggestive work is considered only for subjects who are at least 21 and clearly represented as adults. An original fictional human or humanoid identity used in sensitive work is assigned a canonical age of at least 25 under the studio standard. A real likeness used in such work must be the verified client’s own. Private World Studio does not accept sensitive commissions using an identifiable third-party likeness at launch; any future third-party service would require a separate policy and consent system before being offered.

5. Verification and review

Private World Studio may request clarification or reasonable evidence concerning age, identity, consent, rights or the origin of reference material before or during production. For sensitive self-likeness work, the studio may require third-party 21+ age assurance and a live selfie or equivalent liveness check before production or access to age-restricted material. The studio aims to receive only the minimum verification result needed for compliance rather than retaining identity documents itself.

The studio may pause production while a concern is reviewed. Failure to provide reasonably requested information, or an inconclusive age, identity or self-likeness result, may result in refusal or termination.

6. Fees, payment stages and payment provider

Fees and payment stages are defined in the written proposal. The proposal also identifies the authorised payment method for that project. Private World Studio will not knowingly route a commission category through a payment provider or merchant account that has not approved that category. No payment is required through the public consultation form.

For a sensitive commission, required age or self-likeness verification may be a condition that must be completed before payment, production or delivery, as stated in the proposal. Amounts may become earned as agreed work is performed or resources are irreversibly committed. No general “no refunds” rule applies where a refund or other remedy is required by law.

7. Revisions and changes of scope

Included revision rounds and the process for approving direction are defined in the proposal. Requests outside the approved scope may require a revised quote, schedule or new commission.

8. False information, circumvention and prohibited requests

False or misleading information about age, consent, identity, likeness, ownership, permissions or the intended subject, or an attempt to circumvent the Content & Likeness Policy, may constitute a material breach. Private World Studio may immediately suspend or terminate the commission and will have no obligation to complete or deliver prohibited work.

Where termination results from such a breach, amounts attributable to work already performed, resources committed and non-recoverable costs may be retained to the extent permitted by the proposal and applicable law. The studio may also rely on any other lawful right or remedy arising from the breach.

9. Cancellation and consumer rights

Cancellation consequences are defined in the written proposal and should reflect work already performed and commitments already made. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

10. Production method

Private World Studio combines creative direction, digital image and motion production, editing, sound and post-production. Production systems and third-party software may introduce variations or artefacts, and their capabilities or licences may change. The proposal defines the finished deliverables and correction process rather than guaranteeing every intermediate production result.

11. Intellectual property and exclusivity

Client-supplied materials remain subject to the client’s or third party’s existing rights. Private World Studio retains its background methods, workflows, know-how, templates and production systems. Third-party software and production components remain subject to their own licences.

The proposal defines the licence or assignment applying to commissioned deliverables. Where PWS promises exclusivity, that promise means the studio will not intentionally resell or reuse the client’s private central identity or commission-specific private assets for another client, subject to the precise proposal. It does not imply ownership of third-party tools, general techniques, model capabilities or incidental similarities that may arise independently.

12. Confidentiality and portfolio use

Private commission material is treated as confidential subject to necessary production providers, legal obligations and reasonable protection against abuse. PWS will not intentionally publish client commission material as portfolio work without a separate explicit release.

13. Client use of deliverables

The client must not use commissioned digital media to deceive, defraud, harass, unlawfully impersonate another person or falsely represent a real event. Publication may require disclosure or labelling depending on the platform, audience and applicable law.

14. Operating entity and governing law

The legal operating entity, registration details and governing law applicable to a paid commission will be identified in the written proposal before payment is required.

15. Safety, complaints and contact

Questions about these Terms or a proposed commission can be sent to hello@privateworldstudio.com. A person who believes that material depicts them without valid consent can use the Safety & Removal process. Private World Studio may place relevant production, delivery or publication on hold while a credible complaint is assessed.
